The H-2A temporary agricultural visa is a nonimmigrant visa which allows foreign nationals to enter into the U.S. to perform agricultural labor or services of a temporary or seasonal nature.

The job must be temporary in nature and the need should be for one year or less. The employer's need cannot be ongoing or continuous.

The employer has the burden of establishing the facts necessary to support a finding that the need is seasonal or temporary.

H-2A time counts whether you are in the U.S. or abroad.

H-2A dependents may not work in the U.S.

     

Examples of agricultural works that qualify for H-2A Visa include but are not limited to the followings:

  • Tobacco farm workers.

  • Vegetable farm workers.

    • Apple picking.

    • Sugar cane harvesting.

    • Tomatoes harvesting.

  • Animal herding.

  • Citrus farm worker.

The H-2A visa requires employers to provide a number of benefits to their temporary workers, including minimum rates of pay at least at the prevailing wage level, transportation to and from their temporary residence as well as to new worksites, housing meeting federal standards, meals and workers compensation insurance.
